Can I use a defined switch port tag as availability parameter in vpn site to site configuration to limit only that ports or to be routed into the tunnel

yes correct, after further investigation with Meraki SE it's not possible, thanks a lot for your replay
You could probably do this using Adaptive Policy - but that requires premium licences. Search this page for "inline traffic tagging".
